1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Script Video Teleprompter ("we," "us," "our," or "the App") regarding your use of our mobile application.

If you do not agree to these Terms, do not download, install, or use the App.

2. License Grant

2.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal or commercial content creation purposes
• Access App features based on your subscription tier (Free or Premium)

2.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or redistribute the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to App systems or user data
• Interfere with or disrupt the App's functionality

3. User Accounts and Subscriptions

3.1 Free Tier

The App offers a free tier with limited features:

• Limited number of scripts (typically 3 scripts)
• Limited recording length (typically 2 minutes per video)
• Watermark on exported videos
• Basic features and customization

3.2 Premium Subscription

Premium subscriptions unlock additional features:

• Unlimited scripts and recordings
• Unlimited recording length
• Watermark-free exports
• 4K video quality
• File import capabilities (TXT, PDF, DOCX)
• Advanced customization options
• Priority support

3.3 Subscription Terms

• Billing: Subscriptions are billed through Apple's App Store and managed by Apple.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Payment: Payment is charged to your Apple ID account at confirmation of purchase.
• Free trial: If offered, free trial converts to paid subscription unless cancelled before trial end.
• Cancellation: Manage subscriptions in iOS Settings > [Your Name] > Subscriptions.
• No refunds: Refunds are handled by Apple per their refund policy.

3.4 Subscription Changes

We reserve the right to:

• Modify subscription pricing with 30 days notice
• Change features included in subscription tiers
• Discontinue free trials or promotional offers

Active subscriptions will be honored at their current price until renewal.

4. User Content and Ownership

4.1 Your Content

You retain all rights to content you create using the App, including:

• Scripts you write or import
• Videos you record
• Audio recordings

We do not claim ownership of your content. Your content remains yours.

4.2 Content Responsibility

You are solely responsible for:

• The content you create and share
• Ensuring you have rights to any imported content
• Compliance with copyright, trademark, and other laws
• Obtaining necessary permissions for recorded individuals

4.3 Prohibited Content

While we don't monitor your content, you agree not to create or share content that:

• Violates laws or regulations
• Infringes on intellectual property rights
• Contains hate speech, harassment, or discriminatory material
• Depicts illegal activities or violence
• Contains malware or malicious code
• Violates privacy rights of others

5. Intellectual Property Rights

5.1 App Ownership

The App, including all code, design, graphics, user interface, and functionality, is owned by us and protected by:

• Copyright laws
• Trademark laws
• Patent laws
• Trade secret laws
• Other intellectual property rights

5.2 Trademarks

"Script Video Teleprompter" and associated logos are our trademarks. You may not use them without written permission.

6. Privacy and Data

Your privacy is important to us. Our data practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy points:

• Scripts and recordings are stored locally on your device
• We don't access, store, or share your content
• Anonymous analytics may be collected to improve the App
• Subscription information is processed through Apple and RevenueCat

7. Third-Party Services

The App integrates with third-party services:

• Apple App Store: For downloads, payments, and subscriptions
• Firebase Analytics: For anonymous usage analytics
• RevenueCat: For subscription management

These services have their own terms and privacy policies. We are not responsible for their practices or any issues arising from their services.

8. Disclaimers and Limitations

8.1 No Warranty

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results obtained from the App will be accurate or reliable
• Any errors or defects will be corrected
• The App will be compatible with all devices or operating systems

8.2 Use at Your Own Risk

You assume all risks associated with using the App, including:

• Device damage or data loss
• Recording quality or technical issues
• Compatibility with your specific hardware
• Loss of unsaved content

8.3 Backup Responsibility

You are responsible for backing up your scripts and recordings. We recommend:

• Regularly exporting important scripts
• Saving recordings to your photo library or cloud storage
• Enabling iCloud Backup for app data

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or loss of goodwill
• Damages arising from your inability to use the App
• Damages arising from unauthorized access to your device or data

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100 USD, whichever is less.

10. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you create or share using the App

11. Changes to the App

We reserve the right to:

• Modify, update, or discontinue App features at any time
• Release new versions with changed functionality
• Impose limits on features or storage
• Discontinue the App entirely with reasonable notice

We are not liable for any modifications, suspensions, or discontinuations of the App or any features.

12. Termination

12.1 By You

You may terminate this agreement at any time by:

• Deleting the App from your device
• Cancelling your subscription (if applicable)

12.2 By Us

We may terminate or suspend your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Chargeback or payment disputes
• Any reason at our sole discretion

12.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete all copies of the App
• Provisions that should survive termination will remain in effect

13. Dispute Resolution

13.1 Informal Resolution

Before pursuing formal legal action, please contact us at info@scriptvideoteleprompter.com to attempt informal resolution. We'll work in good faith to resolve disputes within 30 days.

13.2 Governing Law

These Terms are governed by the laws of Slovakia, without regard to conflict of law provisions.

13.3 Jurisdiction

Any legal action must be brought in the courts located in Slovakia. You consent to personal jurisdiction in these courts.

13.4 Arbitration

For disputes that cannot be resolved informally, you agree to binding arbitration under European Arbitration Chamber rules, except:

• Small claims court actions
• Intellectual property disputes
• Requests for injunctive relief

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, strikes, etc.).

14.6 Export Control

You agree to comply with all export and import laws. You represent that you are not located in a country subject to embargo or on any restricted party list.

15. Updates to Terms

We may update these Terms from time to time. Changes will be effective when posted. We will notify you of material changes through:

• In-app notifications
• Email (if we have your email address)
• Updating the "Last Updated" date

Continued use after changes indicates acceptance of updated Terms.

16. App-Specific Terms

16.1 Camera and Recording

• You are responsible for obtaining consent from anyone you record
• Follow all applicable laws regarding recording in your jurisdiction
• We are not responsible for how you use recorded content

16.2 File Import

• You must have legal rights to import and use any files
• We are not responsible for copyright infringement of imported content
• The App may not support all file formats or encodings

16.3 Storage Limitations

• Content is stored on your device; available storage may limit recordings
• We are not responsible for storage limitations or data loss
• Regular cleanup of old recordings is recommended

17. Age Requirements

You must be at least 13 years old to use the App. If you are between 13-18, you must have parental or guardian consent. Users under 13 are prohibited from using the App.
